Donald Trump’s administration has planned to deport undocumented immigrants. A total of 11 million immigrants in the country will be affected by this out of which 3 lakh Indians are at risk. The US President has laid the groundwork for deporting millions of undocumented immigrants. The new guideline issued will broaden the way in which federal immigration laws are enforced.

The Department of Homeland Security (DHS) said in an enforcement memo that “The department no longer will exempt classes or categories of removable aliens from potential enforcement.” It also read, “Department personnel has full authority to arrest or apprehend an alien whom an immigration officer has probable cause to believe is in violation of the immigration laws.”

Two enforcement memos have been issued by the homeland security so as tighten deportation of illegal immigrants. This not only includes criminal immigrants but also others who are in the Country. As per unofficial figures, there are a total of 3,00,000 illegal Indians that might be affected by this law.
According to the memo, the DHS secretary has the authority to apply expedited removal provisions to immigrants who have not been admitted or paroled into the US, who are inadmissible, and who have not been continuously physically present in the US for the two year period immediately prior to the determination of their inadmissibility. These immigrants will be immediately deported unless the immigrant is an unaccompanied minor. Also the minor should have the intention to apply for asylum as he has fear of persecution or torture in their home country. Either these or the immigrants should have legal immigration papers to support their stay.

The memorandum also read that when illegal immigrants apprehended do not pose a risk of a subsequent illegal entry, returning them to the foreign contiguous territory from which they arrived, pending the outcome of removal proceedings, saves the government detention and adjudication resources for other priority immigrants.
