Delhi HC Judge S. Murlidhar Transferred Hours After Reviewing Delhi Riots Case

Justice S. Murlidhar, of the  Delhi High Court (HC,) on the evening of the 26th of February, was transferred to the Punjab and Haryana High Court (HC.) 

If sources are to believe, the orders to transfer Mr. Murlidhar came after the hearing on the Delhi riots.   On the 26th of February, a bench of two comprising Justice S. Murlidhar and Justice Anup Jairam Bhambhani reviewed the Delhi situation and ordered the Delhi police to control it.

Mr. Murlidhar, during yesterday’s hearing also asked the police to file a FIR against the politicians, Kapil Mishra and Anurag Thakur, who instigated violence through their hate speeches, just a few days before the violence erupted.

However, the case is no longer with Justice Murlidhar as the Central Government issued a government notification and transferred him.  The decision was taken after a discussion between Ram Nath Kovind, the President of India and Sharad Arvind Bobde, the Chief Justice of India (CJI.)

Recently, on the 12th of  February, the Supreme Court Collegium also recommended Justice Muralidhar’s transfer to the Punjab and Haryana High Court.  However, the Delhi High Court Bar Association (DHCBA) passed a resolution against the recommendation and did not let the transfer happen.

On the 26th of February, the DHCBA said, “Such transfers are not only detrimental to our noble Institution but also tend to erode and dislodge the faith of the common litigant in the justice dispensation system.”  

The Delhi riot case has been transferred to CJI Sharad Arvind Bobde, whereas, Justice Murlidhar has been asked to resume his charges at the Punjab and Haryana HC soon.
