The Top Court bench, comprising of Justice Satish and Justice Pardiwal have agreed to review the plea, filed with an urgent hearing demand. The SC bench would hear the petition at 5:00 P.M., on the 29th of June, Wednesday.
According to sources, the Shiv Sena claimed the floor test orders given by Mr. Bhagat Singh Koshyari, the Governor of Maharashtra, to be illegal.
In the petition, filed by advocate Abhishek Manu Singhvi, on behalf of the Maha Vikas Aghadi Government, read, “Because for the simple reason a floor test cannot include names which are stigmatised or which cannot otherwise be counted. It will go to the root of democracy.” Citing the reason for urgent hearing, Mr. Singhvi said, If not hear today, “Entire exercise will become futile because which cannot be counted will be counted.”
The Shiv Sena leader Mr. Sunil Prabhu said, the floor test is also illegal and unnecessary, as the matter of the disqualification of the rebel Shiv Sena Members of the Legislative (MLAs) is pending with the Bombay High Court, until the next hearing on the 11th of July. He also mentioned that the notice for the floor test was also given just 24 hours, ahead of the ordered floor test.
Notably, on the 29th of June, Mr. Bhagat Singh Koshyari ordered a floor test, to be held on the 30th of June at 11:00 A.M., asking Chief Minister Uddhav Thackeray to prove his majority.
