On the 2nd of May, Monday, the Supreme Court reviewed a petition and said, “ No one can be forced to take the vaccine.”

The Top Court reviewed a petition filed by Mr. Jacob Puliyel, a former member of the National Technical Advisory Group on Immunisation (NTAGI,) against mandatory vaccination against the Wuhan virus (COVID-19) and restricting public services for unvaccinated people.  The petitioner said, the restrictions imposed by some states on unvaccinated people are a violation of “citizen’s rights” and is unconstitutional.

Responding to the demands of the petitioner, the SC bench comprising of Justice Mr. L.N. Rao and Justice Mr. B.R. Gavai said, “Bodily integrity is protected under the law and nobody can be forced to be vaccinated.”  The court also directed the Government of India to release data regarding the adverse effect of the vaccines for the Wuhan virus.

However, the Apex Court clarified that “certain limitations on individual rights” could be imposed in the interest of community health.  The case was registered against the rule, where many states imposed mandatory vaccination against the Wuhan virus rule, restricting unvaccinated people at public places.  In regard to this, the Court said, “Till infection numbers are low we suggest that no restriction is imposed on individuals on access to public places, services and resources.  Recall the same if already done.”

The Court directed the Central Government to release the clinical trials data and its adverse effect on individuals, as soon as possible.

It is to be noted, many states have imposed mandatory vaccination for individuals, and imposed strict guidelines restricting public transport and services to unvaccinated people.
