SC Postpones Hearing Of Article 370 Petitions

The Supreme Court (SC,) on the 1st of October, did not announce a stay order on the implementation of the Jammu and Kashmir Reorganisation Act, 2019.

A bench of SC judges, led by Justice N.V. Ramana, reviewed the petitions filed by approximately 14 petitioners against the revocation of Article 370 in Jammu and Kashmir.

The SC reviewed the petitions and postponed the hearing to the 14th of November, as the Central Government did not respond to the filed petitions.

According to sources, the SC issued a notice to the Jammu and Kashmir Government and the Central Government, asking them to file their replies.  However, Attorney General K.K. Venugopal, on the 1st of October, appeared in the SC and demanded more time to draft the replies. Solicitor General Tushar Mehta, who is representing the Jammu and Kashmir Government, also asked the same.

The bench of judges approved their demand and gave them time till the 14th of November and asked them to file the affidavits by the next hearing.

In addition, the Court said the Jammu and Kashmir Reorganisation Act, 2019 could be implemented on the scheduled date of the 31st of October.

Despite several attempts by the petitioners for a stay order, the Court did not issue a stay order on the implementation of the Jammu and Kashmir Reorganisation Act.

The Bench justified their decision and said even if the Act comes into effect, the SC could “turn the clock back” in case the Court rules in favour of the petitioners.

The next hearing regarding the revocation of Article 370 in Jammu and Kashmir is scheduled to be held on the 14th of November.
