Nirbhaya Case: SC dismisses plea against release of juvenile

New Delhi: On Monday, the Supreme Court dismissed the plea against the release of the juvenile in the Delhi gang rape case. The court dismissed the plea Delhi Commission for Women chairperson Swati Maliwal against the release of the juvenile in the case of Nirbhaya.

Justice U.U. Lalit, one of the judges on the Bench led by Justice A.K. Goel, said, “We cannot interpret the law (Juvenile Justice Act) to curtail his (juvenile convict) freedom without legislative sanction. We share your concern, but we cannot go beyond the statute.”

While dismissing the plea, the bench comprising Justice A.K. Goel and Justice U.U. Lalit said, “We share your concern but we have no legislative backing to pass the orders. The detention cannot go beyond 3 years.”

Swati Maliwal said, “This is a black day for the entire country, its time for the women of the country to take up torches rather than candles.”
