Hyderabad: The Telangana High Court has affirmed the authority of the police under the City Police Act to take measures against illegal and unsocial activities in gated communities. The court directed the City Police Commissioner to issue detailed guidelines on permissible and prohibited activities in these communities, targeting illegal behaviors like gaming, drug use, alcohol consumption, and public nuisance.
The Commissioner was instructed to provide gated community and flat owners’ associations with a comprehensive guide, including relevant laws and government orders, while also issuing directives to police stations, task forces, and TGNSB for swift action on complaints. The court also recommended the creation of a dedicated app for communities to lodge complaints confidentially.
The ruling followed a petition by KPHB resident Ch. Harigovinda Khorana Reddy, who alleged inaction by the police in addressing illegal activities at Indu Fortune Fields Villas, Hyderabad. The petitioner claimed evidence tampering by security personnel and highlighted that prior police inspections yielded no significant findings despite credible allegations.
Justice B. Vijay Sen Reddy emphasized that gated communities must establish a three-member monitoring sub-committee to oversee public spaces, report violations, and cooperate with law enforcement. Associations were also urged to implement clear rules for clubhouse usage.
