After several rounds of counting of votes, Ms. Mamata Banerjee, the Chief Minister of West Bengal and Member of the Legislative Council (MLC) candidate of Bhawanipore, won the legislature by election with a huge margin of votes. Ms. Banerjee defeated the Bharatiya Janata Party (BJP) candidate Ms. Priyanka Tibrewal, with a record margin of over 58,000 votes. Her victory in the West Bengal by election for Bhwanipore constituency, claimed her triumph against the BJP. With this, now Ms. Mamata Banerjee, according to the law, could hold the post of the Chief Minister.

After the tremendous victory, Ms. Mamata Banerjee said, “I have won the Bhowanipore assembly bypolls with a margin of 58,835 votes and have registered the victory in every ward of the constituency.” She further said, “Around 46% of people here (in Bhowanipore) are non-Bengalis. They all have voted for me. People of West Bengal are watching Bhowanipore, which has inspired me.” She even said, the people of Bhwanipore gave a befitting reply to the BJP, who conspired in Nandigram and won the seat.

After losing the MLA seat in Nandigram Assembly constituency, to hold the Chief Ministry post, Ms. Banerjee needed to win as the MLA. The Bhwanipore Assembly constituency by election was her victory, not only as a MLA candidate, but saved her position as the Chief Minister of West Bengal. Mr. Sovandeb Chattopadhyay, who was the MLA of Bhwanipore Assembly constituency, resigned from the post to make space for Ms. Mamata Banerjee. According to Article 164(4) of the Constitution of India, a minister who is not a member of the Legislature of the State for a period of six consecutive months cannot be the chief minister.
