Rajasthan HC Announces Verdict In Sachin Pilot V/S Assembly Speaker Case Over Disqualification Notice

The Rajasthan High Court (HC,) on the 24th of July, asked the Rajasthan Assembly Speaker to maintain a status quo in the disqualification case.

Recently after the removal of Sachin Pilot as the Rajasthan Deputy Chief Minister, C.P. Joshi, the Assembly Speaker of Rajasthan, issued disqualification notices to Sachin Pilot and 18 other rebel Members of the Legislative Assembly (MLAs.)

The Ashok Gehlot led Rajasthan Government also alleged Sachin Pilot of conspiring against Ashok Gehlot, the Chief Minister of Rajasthan and trying to topple his Government in the State.

However, the Rajasthan HC announced the verdict in the favour of the Sachin Pilot political team, restricting Mr. Joshi from acting on the disqualification notices issued earlier, on the 14th of July.

The decision of the Rajasthan HC came after the Supreme Court dismissed the case, asking the Rajasthan HC to look into the matter.

According to sources, Sachin Pilot submitted an application and challenged the validation of the disqualification notices.

The decision was made on the grounds, the Tenth Schedule’s constitutional validity was under challenge and therefore, the Union of India was a necessary part.

Mr. Pilot and 18 other rebel MLAs challenged the disqualification notices, as the notices were issued at the request of INC’ chief whip for not attending the INC meeting on the 12th and 13th of July.

 

The Sachin Pilot team argued the issued notices on the request of the party whip. The Pilot team said, the request of the Chief Whip applies only when the Assembly is in session.

Meanwhile, the political issues between Sachin Pilot and Rajasthan Government could be an advantage for the opposition Bharatiya Janata Party (BJP.)

After the INC, BJP is the only party with the highest number of MLAs.

Rajasthan has 200 Assembly seats, of which 107 MLAs are of INC, 72 MLAs of the BJP and 21 independent MLAs.

Of the 21 MLAs, 18 supported the INC and 3 the BJP.

The majority mark to form the State Government is 101.
