SC Refuses Stay Orders In AP HC Judgement In SEC Ramesh Kumar Case

The Supreme Court, on the 10th of June, refused to issue a stay order on the decision of the Andhra Pradesh High Court (HC) regarding the N. Ramesh Kumar case.

Recently, the A.P., High Court (HC) announced a verdict in the favour of Ramesh Kumar, the State Election Commissioner (SEC) allowing him to rejoin his duties as SEC.

Ramesh Kumar, after being replaced from his post by the A.P., Government filed a petition in the A.P., HC against the appointment of another SEC, after passing an ordinance.

Disappointed with the HC judgement, the Yuvajana Sramika Rythu Congress Party (YSRCP) moved the SC and filed a petition against HC judgement.

However, the Supreme Court denied the stay order and issued notices to the defendants and ordered a written reply within two weeks. 

The bench of judges which reviewed the matter  was headed by S.A..Bobde, the Chief Justice of India (CJI.)

The CJI said the Y.S. Jagan Mohan Reddy led YSRCP Government did not have good intention in issuing the ordinance, especially during the pandemic crisis.

In regard to this, the SC decided to not differ with the Andhra Pradesh HC and refused stay orders for the HC judgement in the Ramesh Kumar case.

Meanwhile, Ramesh Kumar is continuing with his duties as the SEC of Andhra Pradesh.
