Hyderabad: Telangana High Court delivered a sensational judgment and directed the governor to bound for the cabinet decision in selection of MLCs. Court set aside the orders passed by governor Tamilisai Soundara Rajan rejecting the cabinet resolution made suggesting Dasoju Sravan Kumar and Kurra Satyanarayana under governor quota MLCs.
The court also rejected the appointment of Professor Kodanda Ram and Amanulla Khan as governor quota MLCs. The court opined that the governor has some discretionary powers, but still courts can intervene if they take any intentional decisions with vested interests.
High court said that the governor should comply with the suggestions and recommendations made by the council of ministers following article 175 (5) of constitution of India.
The HC bench said that the governor cannot take any decision on their own without consulting the council of ministers. Though the governor has some discretionary powers as per the article 361 this petition will not come under that, the court said.
