SC might revive charges against accused BJP leaders in Babri case

The Supreme Court is expected to revive the conspiracy charges against the BJP leaders L.K. Advani, Murli Manohar Joshi and Uma Bharti. The Bench is expected to meet on March 22 and hear on this case. On Monday, the SC gave an indication that a bench led by Justice P.C. Ghose is set to hear on this aspect.

They will be hearing an appeal filed by Haji Mahboob Ahamad and CBI stating the conspiracy charges against Advani and other leaders. This includes the Rajasthan Governor Kalyan Singh who was UP CM at the time of demolition. SC is also expected to bring together Lucknow and Rae Bareli cases that involve these leaders. This decision came after the SC expressed concern over the delay in 2015 court trials and hence hold joint trials soon.

The court also approached Mr. Advani and 19 others for responses on a petition that needs them to attend the court on charges of conspiracy in demolishing Babri Masjid in 1992. The CBI accused the 20 leaders, but these charges were discharged by Allahabad High Court in 2010 and Supreme Court upheld this decision.

A Bench held by Chief Justice H.L. Dattu in 2015 issued a notice to Mr. Advani, Dr. Joshi, Ms. Bharti and Mr. Singh. SC also asked the CBI for an explanation as to why they delayed the appeal against High Court Order. In regard to this, the petitioner Haji Mahboob Ahamad said “It is further material to submit that in the last one year there has been a change of Central government wherein the leaders of the same political party [BJP] have become the government. The CBI may not seriously uphold the rule of law.”

He also alleged that there were several accused in the present government higher positions who might have influenced the CBI in this delay.
