The Constitution (103rd Amendment) Act, 2019, will soon come into effect in Rajasthan.

The Indian National Congress (INC,) the ruling Government in Rajasthan, on the 19th of February, clarified, the 10 % reservation will soon be enforced in the State.

According to the Constitution (103rd Amendment) Act, anyone with an annual income of less than Rs. 8 lakhs will be given 10 % reservation. The 10 % reservation is given to the economically weaker sections (EWS) belonging to the General Category.

The Department of Personnel (DoP) of Rajasthan issued a notice which states, there would “be 10% reservation of vacancies for economically weaker sections in direct recruitment and this would be in addition to the existing reservation.” It further read, “In the event of non-availability of eligible and suitable candidates amongst economically weaker sections in a particular year, the vacancies so reserved for them shall be filled in accordance with the normal procedure.”

However, the State did not make any clarifications regarding 10 % reservation in the educational institutions.

The State only approved the quota for the EWS in the field of government jobs.

Rajasthan is the first INC ruling state to implement the Act. The other INC ruling states like Chhattisgarh and Madhya Pradesh are still scrutinising the Constitution (103rd Amendment) Act.

The Constitution (124th Amendment) Bill, 2019 was introduced by the Union Government of India in the Lok Sabha. The Bill was then passed by the Lok Sabha and the Rajya Sabha.

Later, Ram Nath Kovind, the President of India, on the 12th of January, gave his approval, making this Bill an Act, the Constitution (103rd Amendment) Act 2019.
