The fight over real Shiv Sena continues, as the Uddhav Thackeray faction of the Shiv Sena party has approached the Supreme Court (SC) against the proceedings of the Election Commission.

Notably, the Election Commission of India issued a letter to the two factions of the Shiv Sena, one led by Mr. Eknath Shinde, the new Chief Minister of Maharashtra and another one led by Mr. Uddhav Thackeray, the former Chief Minister of Maharashtra.  In the letter, the EC asked the two factions to prove the majority and stake claims of the party, which has been founded by Mr. Bal Thackeray.  The documents to prove the majority have been asked to submit by the 8th of August.

The developments came after Maharashtra Chief Minister Eknath Shinde led the group for recognition as the real Shiv Sena and wanted claims of the party and submitted a plea in this regard to the EC.

Furthermore, in the fresh plea to the Supreme Court against the poll panel, which asked the two Shiv Sena factions to prove the majority.  In addition, the Uddhav Thackeray faction has also written to the Election Commission, requesting it not to go ahead with the plea of the Maharashtra CM Mr. Eknath Shinde faction in view of the pendency of a batch of petitions in the top court. 

In the plea, the Shiv Sena said, “Despite being asked not to precipitate the matter and stay its hand, the Hon’ble ECI has decided to initiate proceedings… Such proceedings will be in the teeth of settled law that an inquiry into a matter which is sub judice before the court amounts to interference with the judicial proceedings.”

The Supreme Court bench is yet to list the matter for review.
